【摘要】 旅行限制作为《国际卫生条例》允许使用的额外卫生措施，目的在于阻却重大疫情的国际传播，但旅行限制易被滥用。《国际卫生条例》虽未对旅行限制滥用直接进行界定，但蕴含着判断此滥用的必要性、科学性及相称性标准。旅行限制之滥用，虽有主客观原因，但会对世界经济与人权保护形成冲击，且不利于疫情的应对。由于《国际卫生条例》是迄今传染病防控领域最为重要的国际条约，故防控旅行限制的滥用需重在完善《国际卫生条例》的相关制度。为此，需针对《国际卫生条例》的不合理之处，通过明确旅行限制实施前提、变革WHO争端解决机制等途径对其进行完善。我国是《国际卫生条例》的缔约国，应对标《国际卫生条例》,重视该条例强调的旅行限制当恪守的科学原则与比例原则，完善与旅行限制的相关法律规定，为国际社会平衡疫情防控与国际旅行的关系树立典范。更多还原

【Abstract】 Travel restrictions, as additional health measures permitted under the International Health Regulations, aimed at preventing the international spread of major outbreaks, are vulnerable to abuse. Although the “Regulations” do not directly define the abuse of travel restrictions, it contains the necessity, scientificity and proportionality criteria for judging abuse. The abuse of travel restrictions, although there are subjective and objective reasons, will have an impact on the world economy and human rights protection, and will be detrimental to the response to the epidemic. As the “Regulations” is by far the most important international treaty in the field of infectious disease prevention and control, the prevention and control of the abuse of travel restrictions should focus on improving the relevant systems of the “Regulations”. In view of the unreasonable aspects of the “Regulations”, the improvement of the “Regulations” should be carried out by clarifying the prerequisites for the implementation of travel restrictions and reforming the WHO dispute settlement mechanism. Our country is a State Party to the “Regulations”, and the “Regulations” emphasize that the implementation of travel restrictions should be based on scientific principles and proportional principles and should be taken seriously. Therefore, our country should comply with the “Regulations” and improve the legal provisions related to travel restrictions, providing a model for the international community to balance the relationship between epidemic prevention and control and international travel.更多还原
