【Abstract】 Families of the elderly with mental handicapped face the dual pressures of supporting the elderly and assisting the disabled. The core is how to effectively manage property and use it exclusively for the protection of the rights and interests of the mentally handicapped. The trust system has the characteristics of professional property management, the function of freezing the trustee’s wills, and the independence of the trust property, which are suitable for resolving the concerns of such families and ensuring the legitimate rights and interests of the beneficiaries. The protective trust for the elderly with mentally handicapped includes two models: private trust and public trust. The establishment, trust property, and trust parties of a mentally handicapped protective trust for the elderly should also be designed according to the trust model to meet the actual needs of the mentally handicapped family.更多还原
