【摘要】 终身监禁是将"牢底坐穿"吗?对此需要从法教义学的视角对终身监禁变更执行中的争议问题进行分析。终身监禁不是《刑法》第50条第1款死缓变更的例外规定,被判终身监禁的罪犯在死缓考验期间有重大立功表现的,应当减为25年有期徒刑。终身监禁中"不得减刑"的规定不是《刑法》第78条"可以减刑"的例外规定,而是该条"应当减刑"的例外规定,罪犯在终身监禁执行期间有重大立功表现的,不能减为有期徒刑,而应继续执行终身监禁。终身监禁不是《刑事诉讼法》第265条暂予监外执行的例外规定,对于被判终身监禁的罪犯可否暂予监外执行,应当根据《刑事诉讼法》第265条的规定予以确定。总之,判处终身监禁并不意味着罪犯一定要将"牢底坐穿",执行终身监禁则意味着罪犯要将"牢底坐穿"。更多还原

【Abstract】 Is life imprisonment meant to " wear out the prison" ? It is necessary to analyze the controversial issues in the implementation of the change of life imprisonment from the perspective of doctrine of law. Life imprisonment is not an exception to the change of death sentence with reprieve in paragraph 1,Article 50 of the Criminal Law. If a criminal sentenced to life imprisonment performs significant meritorious service during the test with death sentence with reprieve,he shall be commuted to fixed-term imprisonment of 25 years. The provision of " no commutation of sentence" in life imprisonment is not the exception provision of " the sentence may be commuted" in Article 78 of the Criminal Law,but the exception provision of"the sentence shall be commuted"in the article. If a criminal sentenced to life imprisonment has performed significant meritorious service during the execution of life imprisonment,he shall not be commuted to fixed-term imprisonment,but shall continue to serve life imprisonment. Life imprisonment is not an exception to the temporary execution outside prison stipulated in Article 265 of the Criminal Procedure Law. Whether a criminal sentenced to life imprisonment can be temporarily executed outside prison during the execution of his sentence shall be dealt with according to the provisions of Article 265 of the Criminal Procedure Law. In a word,the sentence of life imprisonment does not mean that the criminal must " wear out the prison",but the execution of life imprisonment means that the criminal must " wear out the prison".更多还原
