【摘要】 在个人医疗数据的利用中,个人医疗数据所承载的人格权益和财产权益是知情同意所保护的权益。在政府为实现公共利益而公开个人医疗信息、医疗机构将大数据用于商业共享时,不可避免地损害数据主体权益,这给数据主体知情同意带来伦理风险和挑战。实现公共利益是限制数据主体知情同意权的事由,医疗机构对大数据的商业共享一般以数据主体知情同意为必要前提,并由此提出保障医疗数据利用知情同意的伦理原则与实现路径。更多还原

【Abstract】 In the use of personal medical data,the personality rights and property rights carried by personal medical data are the rights and interests protected by informed consent.When the government realizes public interest disclosure of personal medical information and medical institutions use big data for commercial sharing,the rights and interests of data subjects will inevitably be damaged,which brings ethical risks and challenges to informed consent of data subjects.The realization of public interests is the reason that restricts the informed consent of data subjects.Medical institutions’ commercial sharing of big data generally takes the informed consent of data subjects as the necessary premise.Therefore,ethical principles and implementation paths for the protection of informed consent for the use of medical data are proposed.更多还原
