【Abstract】 Legalization of advance medical directive is more powerful to guarantee to the patient’s autonomy. To make the law more perfect, in the process of legislation,the conflict between patient’s right of self-determination and physician’s right of discretion has to be faced. However, doctors often refuse to comply with advance medical instructions on the basis of a priority to protect the right to life. Therefore, the legislation needs to formulate strict execution condition, invalid medical judgment procedure and physician exemption clause, to balance the rights of the two, and ensure the smooth implementation of advance medical instructions.更多还原
