【摘要】 监管沙盒制度已经在全球范围内受到重视,内蕴着金融市场主体从对抗性的"身份"规制向共治性的"契约"治理转变的法理逻辑,并以基于充分合意的测试规则之构建、基于通畅交流的制度供给之完善、基于分配正义的金融消费者保护三种形态体现在制度架构中。我国的金融监管理念应当从中汲取养分,树立一种具备开放性、兼容性的包容性监管理念,实现金融公平、金融安全与金融效率的动态平衡以及各利益相关主体的良性互动和关系协调。更多还原

【Abstract】 The regulatory sandbox has attracted worldwide attention. It contains a kind of legal logic in which financial market entities transform from confrontational "identity " regulation to co-governance"contractual "governance. This will be presented in the institutional framework by the construction of the test rules based on wide agreement, the perfection of the institutional supply based on smooth communication,and the protection of financial consumers based on distributive justice. The Chinese financial supervision must benefit from it, and cement the regulatory principle of openness and inclusiveness. The dynamic equilibrium of financial fairness,financial security and financial efficiency should be realized,and the constructive interaction and relationship coordination among stakeholders should also be promoted.更多还原
