【摘要】 扩大地方性法规行政处罚设定权是行政处罚法修改的一项重要任务。由于设定行政处罚本质上是立法活动,因此扩大地方性法规行政处罚设定权,不仅要考虑地方治理实践的需求,更要符合立法权配置的基本原则。《行政处罚法(2021)》因应行政处罚实践的需要,在适度增加地方性法规可以设定的行政处罚种类的同时,通过明确地方性法规在上位法对违法行为未规定行政处罚情况下可以补充设定行政处罚,一定程度地扩大了地方性法规设定行政处罚的范围。补充设定权条款的确定,在丰富《立法法》第73条规定的地方立法类型的同时,也意味着其所设定的行政处罚要受制于上位法对违法行为的规定,处于从属地位,既要遵循"不抵触"原则的实体限制,也要保持必要的克制,还要受到严格的程序约束。更多还原

【Abstract】 Expanding the power to set administrative penalties in local laws and regulations is an important task in the revision of the Administrative Penalty Law.Since the setting of administrative penalties is essentially a legislative activity, the expansion of the power to set administrative penalties in local laws and regulations must not only consider the needs of local governance practices, but also comply with the basic principles of legislative allocation.The “Administrative Punishment Law(2021)” responds to the needs of administrative punishment practice, while appropriately increasing the types of administrative punishments that can be set by local laws and regulations, and at the same time, it can be supplemented by clarifying local laws and regulations when the upper law does not provide for administrative punishments for violations.The establishment of administrative penalties has expanded the scope of administrative penalties set by local laws and regulations to a certain extent.The determination of the supplementary power to establish clauses not only enriches the types of local legislation stipulated in Article 73 of the Legislative Law, but also means that the administrative penalties set by it are subject to the provisions of the upper law on violations and are in a subordinate position.It is necessary to follow the substantive restrictions of the “non-conflict” principle, but also to maintain the necessary restraint, but also to be subject to strict procedural constraints.更多还原
