【摘要】 科研仪器设备是高校"双一流"建设的重要物资保障,但因其易受到采购周期长、风险大等客观因素的影响,在采购活动完成之后常会出现合同履行方面的问题。而现有的政府采购合同管理相关法律规定无法真正解决合同纠纷争议,实现政府采购活动的目的。通过借鉴欧盟在政府采购合同管理方面的规定,建议我国加快政府采购合同管理的相关立法,完善合同履行验收环节的具体规定,并在高校内部建立完备的内控审查制度。更多还原

【Abstract】 The scientific experiment instrument is an important material guarantee for the "double first-class" construction in universities. However, due to objective factors such as long procurement cycle and high risk, there are problems in contract performance after the completion of procurement activities. The existing laws and regulations on contract management of government procurement cannot really solve contract disputes and realize the purpose of government procurement. By referring to the regulations of EU on the management of government procurement contract, it is suggested that China should speed up the relevant legislation of government procurement contract management, improve the specific provisions of contract performance and acceptance, and establish a complete internal control review system in universities.更多还原
