【摘要】 随着生活垃圾强制分类时代的到来,完善的生活垃圾管理地方立法关系到生活垃圾分类的效果。通过对我国生活垃圾管理地方立法现状的梳理,目前存在立法模式不一、立法名称混乱、分类标准杂乱等主要3个问题。今后的立法应当以城乡经济发展水平为依据确定立法模式;立法名称现阶段以管理为宜,以治理为发展趋势;分类标准的制定以统一性、整体性、可接受性为原则。从而优化我国生活垃圾管理地方立法,实现生活垃圾法治化管理的持续性发展。更多还原

【Abstract】 With the coming of the era of mandatory household garbage classification,the perfect local legislation of household garbage management is related to the effect of household garbage classification. Through sorting out the current situation of local legislation on domestic waste management in China,there are three major problems,including different legislative models,confused legislative names and disorderly classification standards. In the future,the legislation should be determined according to the level of urban and rural economic development. At the present stage,the legislative name should be appropriate to management,and the development trend is governance. The establishment of classification standards should be based on the principles of unity,integrity and acceptability. So as to optimize the local legislation of domestic garbage management and realize the sustainable development of domestic garbage management under the rule of law.更多还原
