关于《侵权责任法》中“医疗损害责任”条文在医学实践教育中的应用与研究

【摘要】 目的:使医学与法学专业知识进行融合在一起,创建一个新型的医事法学模拟技术课程设计教学。方法:将石河子大学医学院2015级临床医学专业及石河子大学医学院2020级全科医学专业学员100人分组培训并进行考核,根据实际考核成绩换算成等级分A级(90~100分)、B级(80~90分)、C级(70~80分)、D级(70分以下)4级,通过统计学分析评价两种教学效果。结果:A级:医事法学组人数多于医学组,差异无统计学意义(P>0.05);B级:医事法学组人数多于医学组,差异有统计学意义(P<0.05);C级:医事法学组人数低于医学组,差异无统计学意义(P>0.05);D级:医事法学组人数明显低于医学组,差异有统计学意义(P<0.05)。结论:本研究在国内首次把《侵权责任法》中"医疗损害责任"法律条款应用于医学临床实践教育工作实践中,通过多种教学方法,使医科课程与法律课程相结合,增强医学生理解、分析和解决临床实践中遇到医疗纠纷的能力,形成了一种规避医疗风险的训练手段。

【Abstract】 Objective: To make the medical and law professional knowledge to be integrated together to create a new medical law simulation technology curriculum design teaching. Methods:200 students of clinical medicine major of grade 2015 and general medicine major of grade 2020 of medical school of Shihezi University were trained in groups, and then assessed.According to the actual assessment results, the grades were converted into four grades: A(90-100 points), B(80-90 points), C(70-80 points) and D(below 70 points). The two teaching effects were evaluated by statistical analysis. Results:Grade A: the number of the medical law group was higher than that of the medical group, and the difference was not statistically significant(P>0.05).Grade B: the number of medical law group was more than that of medical group, the difference was statistically significant(P<0.05);Grade C: The number of people in the medical law group was lower than that in the medical group, and the difference was not statistically significant(P>0.05).Grade D: the number of students in the medical law group was significantly lower than that in the medical group, and the difference was statistically significant(P<0.05). In conclusion, the teaching effect of the medical law group was better than that of the medical group. Conclusion:This study at home for the first time the tort liability act“medical liability for damage”in the law applied to the medical clinical practice education work practice, through a variety of teaching methods, to combine medical curriculum and law courses, enhance the medical students understand, analyze and solve encountered in clinical practice the ability of medical disputes, formed a means to circumvent the risk of medical training.
