【摘要】 "一带一路"倡议实施过程中人民币兑换存在诸多风险,如地缘政治风险、外汇管制风险、操作风险等,需从国内法和国际法两方面加强风险防范。从国内法来看,首先要在汇率形成机制、资本项目可兑换等方面全面深化国内金融改革,防范系统性金融风险;同时要完善金融企业法人治理结构和内部控制制度,以宏观审慎监管为基础构建现代金融监管制度框架,健全风险监测预警机制与早期干预机制,并重视汇率风险工具的使用;另外还要加强金融人才与信息服务制度建设,并制定统一的外汇管理法规,严厉打击货币金融违法犯罪活动。从国际法来看,需推动中外双边、多边货币金融、投资贸易条约的签订与完善,深化与沿线国家的金融合作;同时推动国际金融秩序改革,促进区域性、全球性货币金融统一规则的制定与实施,共创稳定有序的国际金融秩序;另外要着力构建人民币规则体系,全面推进人民币国际化,并建立和完善全球性金融机构与金融服务体系。更多还原

【Abstract】 During the implementation of the“Belt and Road”initiative,there are many risks in RMB conversion,such as geopolitical risks, foreign exchange control risks, operational risks, etc. It is necessary to strengthen risk prevention from both domestic and international laws. From the perspective of domestic laws,we must first comprehensively deepen domestic financial reforms in terms of exchange rate formation mechanism and capital account convertibility to prevent systemic financial risks;at the same time,we must improve the corporate governance structure and internal control system of financial enterprises,based on macro—prudential supervision Construct a modern financial regulatory system framework,improve risk monitoring and early warning mechanisms and early intervention mechanisms,and attach importance to the use of exchange rate risk tools;in addition,strengthen the construction of financial talents and information service systems,and formulate unified foreign exchange management regulations to severely crack down on monetary and financial violations criminal activities.
