【摘要】 随着全球范围内知识产权保护力度的不断强化,知识产权许可授予的条件与范围也愈加严苛。尤其是在大量存在技术标准的工业领域中,以维护行业标准的名义而实施的滥用知识产权行为,已经引发了竞争当局的关注。探索降低知识产权交易成本的有效方式,以期兼顾实现知识产权保护与促进经济产业发展之目标,已成为当今知识产权许可领域中的重要议题。通过探讨典型的强制许可制度,并研究其一般性强制授权的正当性、必要性与可实施性,说明在依合理商业条件协商无法达成授权协议时,出于维护市场竞争及满足市场需求等公益目的,以强制许可作为衡平权利人私益与社会公益的最后法律手段,是处理这一矛盾可实施性较强的措施。更多还原

【Abstract】 With the strengthening of intellectual property protection worldwide,the conditions and scope of intellectual property license are becoming more and more stringent.In particular,the abuse of intellectual property rights in the name of upholding industrial standards has attracted the attention of competition authorities,especially in the industrial field where a large number of technical standards exist.It has become an important issue in the field of intellectual property licensing to explore an effective way to reduce the transaction cost of intellectual property so as to realize the goal of intellectual property protection and promote the development of economic industry.By discussing a typical compulsory license system,and studies the legitimacy of its general compulsory licensing,necessity and practical,in according to reasonable commercial terms is no authorization agreement negotiations,due to maintain competition in the market and meet the market demand and other public welfare purposes,compulsory licensing as the end of the holder of the equity interests and social public welfare legal means,is to deal with this contradiction can be sexually stronger measures.更多还原
