【摘要】 网络直播抽奖行为有别于传统的有奖销售。网络直播平台的抽奖机制如果存在越轨风险,会在一定程度上催生诈骗型、赌博型、色诱型三种网络越轨行为。网络直播抽奖行为超越合法规则时,内部主体之间往往存在刑事责任分配、共犯形态竞合、加重情节认定等实务难题。刑法介入网络越轨行为时必须在规范维度符合法条的规范目的,在现实维度具有刑事防控的需求。网络直播抽奖越轨行为的规制路径应以非刑罚处遇措施衔接行政处罚的二元模式为主。更多还原

【Abstract】 Live webcast lottery draw behavior is different from the traditional sales with prizes. If the lottery mechanism of network broadcast platform has deviant risk, it will induce three kinds of network deviant behavior, including the gambling type, the fraud type and the seduction type. When the online live lottery acts exceed the legal rules, there are many practical problems such as the distribution of criminal responsibility, the complicity and the aggravating circumstances. When the criminal law has to intervene in the network deviant behavior, it must conform to the standard goal of the law in the standard dimension, and has the demand of criminal prevention and control in realistic dimension.
