【摘要】 疫苗具有公共品的属性,关系到千家万户,是保障国民健康的基础环节。疫苗损害风险存在不确定性,完善疫苗损害救济机制是分散和共担疫苗损害风险的制度保证。随着企业疫苗责任强制保险的介入,我国将形成以政府行政补偿救济和企业责任保险补偿救济双主体的疫苗损害救济体系。结合目前双主体疫苗损害救济体系存在的问题,本文认为应遵循疫苗补偿救济"无过错"原则,完善疫苗损害救济的法制建设、制度建设、明确多元主体的职责定位、加强商业保险模式,并形成政府、市场、社会共担风险的疫苗损害救济机制。更多还原

【Abstract】 Vaccines have the properties of public goods, which are related to thousands of households and are the basic protection for national health. There is uncertainty about the risk of vaccine damage, and perfecting the vaccine damage relief mechanism is the institutional guarantee of dispersing and sharing the risk of vaccine damage. With the intervention of enterprise vaccine liability compulsory insurance, China will form a two-subject vaccine damage relief system with government administrative compensation relief and enterprise liability insurance compensation relief. Combined with the existing problems of the two-subject vaccine damage relief system, this paper holds that we should follow the principle of "no fault" of vaccine compensation relief, improve the legal system construction, system construction, clarify the responsibility orientation of multiple subjects, strengthen the commercial insurance model, and form a vaccine damage relief mechanism in which the government, market and society share the risk.更多还原
