【摘要】 新修订的《中华人民共和国未成年人保护法》赋予了未成年人参与家庭、学校和社会事务的权利。未成年人参与权的内涵复杂,权利配置尤为困难,是家庭事务中最容易受到忽视也最难实现的权利。未成年人实现家庭事务参与权面临着参与主体性不足和参与能力不足的困境。对此,应当从未成年人参与家庭事务的事项范围、重要程度、认知能力、方式途径和救济途径五个方面健全法律规范,促进未成年人家庭事务参与权的实现。更多还原

【Abstract】 The newly revised Law of the People’s Republic of China on the Protection of Minors gives minors the right to participate in family, school and social affairs.The connotation of minors’ right to participate is complex, and the allocation of rights is particularly difficult.It is the most neglected and most difficult right to realize in family affairs.Minors are facing the dilemma of insufficient participation subjectivity and insufficient participation ability in realizing the right to participate in family affairs.In this regard, the legal norms should be improved from the five aspects of minors’ participation in family affairs, the scope, importance, cognitive ability, ways and means of relief, to promote the realization of minors’ right to participate in family affairs.更多还原
