【摘要】 《民法典》第1176条对"自甘风险"作出了规定,并于2021年1月1日起实施。这不仅有利于减轻开展体育活动的学校在学校体育伤害事故中所承担的责任,同时还能够起到促进学校体育发展的作用。该文通过案例分析法、文献资料法等,对"自甘风险"在学校体育伤害事故中的适用进行研究。并结合司法实践,归纳总结出"自甘风险"若适用在学校体育伤害事故中将面临的挑战与其存在的问题。更多还原

【Abstract】 Article 1176 of the Civil Code introduces the concept of "assumption of risk" and will be implemented from January 1, 2021. This not only helps to reduce the responsibility of schools carrying out sports activities in school sports injury accidents, but also plays a role in promoting the development of school sports. This paper aims to study the application of "assumption of risk" in school physical education injuries by means of case study and literature review. Combined with judicial practice, the challenges and problems of the application of "assumption of risk" in school sports are summarized.更多还原
