【摘要】 健康医疗大数据的共享使用具有强监管性、应用场景多样性、非营利公权使用性等特征。在健康医疗大数据的共享使用中，应改变传统的授权机制：从传统的数据主体授权转向数据控制者授权，从单一授权转向多重授权，从单一场景使用目的授权转向多场景使用目的授权。为更好地促进健康医疗大数据的发展，构建私权保护与公益促进的共享合作共赢机制，应建立健康医疗大数据共享中数据使用的授权模式，构建以法定授权为主、委托授权为辅，概括授权为主、特别授权为辅；默示授权为主、明示授权为辅的健康医疗大数据共享授权模式，从而在促进健康医疗大数据共享使用的基础上，最大限度地保护数据主体权益。更多还原

【Abstract】 The shared use of health and medical big data has the characteristics of strong supervision, diverse application scenarios, and the use of non-profit public rights.
