【摘要】 《中华人民共和国公职人员政务处分法》(以下简称《政务处分法》)于2020年6月20日经第十三届全国人民代表大会常务委员会第十九次会议通过,于2020年7月1日起施行。文章通过对政务处分权的释义,《政务处分法》对实践的指导意义,《政务处分法》发展的空间与思路等三个方面对当前《政务处分法》在理论与实践方面进行了梳理,总结出《政务处分法》的实施可以较好地解决监察机关行使政务处分权与公职人员任免机关、单位行使处分权之间协同性不足的问题,可以有效解决两种以上行为受处分时如何执行的问题,总结出该法的实施充分衔接了政务处分与刑事责任追究及行政处罚决定,并为监察机关实践操作提供了具体的法律依据等。另外,文章对政务处分法发展的空间与思路进行了展望:建立政务处分执行效果反馈制度,构建政务处分权司法救济制度,建立监察权国家赔偿制度。更多还原

【Abstract】 The Law of the People’s Republic of China on Administrative Discipline for Public Officials(hereinafter referred to as the Law on Administrative Discipline) was adopted by the 19 th session of the Standing Committee of the Thirteenth National People’s Congress of the People’s Republic of China on June 20,2020, and shall come into force on July 1,2020.Through paraphrase of the administrative discipline right,practical guiding significance of the Law on Administrative Discipline,and the development space and thinking of the law,this paper combs the theory and practice of the current Law on Administrative Discipline,and concludes its implementation can better solve the problems of insufficient synergy between supervision organs exercising the administrative discipline right,and the recruitment organs as well as units,and also can effectively solve the problem of how to carry out discipline when public officials have two or more kinds of illegal conducts.The paper concludes that the law’s implementation fully connects the administrative discipline,criminal responsibility investigation and the administrative discipline decision,and also provides the specific legal basis for the practical operation of the supervision organs.In addition,the paper looks forward to the development space and ideas of the Law on Administrative Discipline:establishing the feedback system of the administrative discipline execution effect,constructing the judicial relief system of administrative discipline right,and establishing the national compensation system of the supervision right.更多还原
