【摘要】 意大利劳动法制度独具国家风格,并且与意大利工会运动的发展同频共振。法西斯时期"职团制"的建立,曾一度使工会活动陷于停滞。二战后工会组织的重生,又对意大利劳动法治发展起到了很大的推进作用。在简要梳理意大利劳动法治的历史脉络的基础上,基于比较法视角,对意大利和中国劳动立法、劳动法律的遵从、劳动执法及劳动司法等劳动法治主要环节进行了实务研读,尤其是对意大利工会的独特法治角色进行了聚焦透析。在凸显意大利现代劳动法治国别特征的同时,意欲为"一带一路"倡议背景下中国企业的"走出去"描画勾勒出意大利现代劳动法治基本环境及其前沿问题。更多还原

【Abstract】 The Italian Labor Law system has its own national style and resonates with the development of the Italian trade union movement. The establishment of the Confederazioni Nazionali during the fascist era had once brought trade union activities to a standstill. After the Second World War, the rebirth of labor unions played a great role in promoting the development of rule of labor law in Italy. On the basis of the generalization of the history of the rule of labor law in Italy, the auhors analysed practically the basic components of both Italian and Chinese labor law including legislation, law enforcement, depute resolutions and law abiding from the perspective of comparative law. The authors focused especially on the unique role of the Italian labor unions under the rule of labor law. While highlighting the national characteristics of modern rule of labor law in Italy,the authors aimed to outline the fundamental business legal environment and frontier issues of modern rule of labor law in Italy for enlightening the Chinese "going global"enterprises under the background of "One belt and one road"initiative.更多还原
