【摘要】 "党内法规"的属性存在法律说、法和政策说、软法说、软硬兼备说等不同观点,学者从多学科研究视角、运用不同理论论证党内法规的法规范属性。承认规则理论可以整体性论证党内法规的权威性、持续性、应当性和有效性的法规范属性。党内法规的权威性表现为制定主体与权限法定、制定依据法定、名称、文本与规范事项法定、程序严格四个方面。党内法规持续性表现为社会成员普遍服从党内法规及党内监督管理人员将党内法规作为衡量党组织、党员等的共同标准,而党内法规本身的权利义务规范是党员行为"应当性"的辩护标准,党内法规的有效性体现为对党组织、党员、其他公权力组织与公权力行为人的约束力。更多还原

【Abstract】 At present, there are different views on the attribute of the rules of CPC, such as the theory of law, law and policy, the theory of soft law and the theory of both soft and hard. Scholars use different theories to demonstrate the legal attribute of it. The theory of recognition rules can demonstrate the authority, continuity, necessity and validity of it as a whole. The authority of the rules of CPC is manifested in the following four aspects: statutory subject and authority, statutory basis, statutory name, statutory text and normative matters, and strict procedures. The sustainability of it shows that the members of the society generally obey it and the inner-party supervisors and administrators regard it as the common standard to measure the party organizations, Party members, etc. The norms of rights and obligations in the rules of CPC are the defense standards of Party members’ behavior "ought to be". The effectiveness of the rules of CPC embodies the binding force on party organizations, party members, other public power organizations and public power actors.更多还原
