【摘要】 对近年来的20例判决书的分析显示:贵州省黑社会性质组织犯罪在组织、行为、经济及非法控制等方面具有一定特性,与全国和国外的黑社会组织相比,贵州省的黑社会组织形式仍处于中低级程度。目前已被瓦解的组织还没有死灰复燃及与其他组织重组的现象,其未来演化表现出组织结构呈多元化、暴力手段呈隐蔽化、经济利益来源呈合法化、非法控制跨区域化等趋势。在司法认定方面,应着重解决"组织者、领导者、积极参加者、一般参加者""软暴力""经济实力"和"跨区域化"等的认定问题。更多还原

【Abstract】 The analysis of 20 judgments in recent years shows that the underworld crime in Guizhou Province has certain characteristics in organization, behavior, economy and illegal control. Compared with that of other places in China and of foreign countries, the underworld organization in Guizhou Province is still in the middle and low level. At present, the organizations that have been disintegrated have not been revived and restructured with other organizations. Their future evolution shows the trend of diversified organizational structure, concealment of violent means, legalization of economic interest sources, and cross-regional illegal control. The identification of organizers, leaders, active participants, general participants,soft violence, economic strength and cross-regional and so on are the focuses in judicial determination.更多还原
