【摘要】 以中国裁判文书网下载的926份行贿罪判决文书为样本,利用SPSS25软件对样本进行相关性分析研究。发现行贿罪量刑与各省域经济水平间的相关性不明显,指出我国行贿罪在量刑方面存在影响因素单一化、个案正义彰显不足、刑罚预防目的最终落空等问题。由此,提出构建行贿罪量刑与省域间经济发展水平相挂钩的建议,以为现有行贿罪的量刑提供更具规范化意义的标准:增设"犯罪行为当时当地经济状况"为罚金刑的裁量依据,完善"刑法典+司法解释"二元化量刑标准,提升司法能动性,以在个案的裁判中实现刑法正义。更多还原

【Abstract】 Based on the 926 judgment documents downloaded from adjudication network,SPSS software was used to analyze and study the correlation of the samples.It is found that there is no obvious correlation between the sentencing of bribery crime and the regional economic level of each province.There are some unreasonable phenomena in the sentencing of bribery crime,such as simplified influence factors,imbalance between culpability and punishment and lost purpose of penalty prevention.The author put forward the suggestion that the sentencing of bribery crime and the regional economic level of each province should be tied by adding"the local economic situation of the crime at that time"as the judgment basis of the fine penalty,completing the Criminal Code and judicial interpretation of the dualistic sentencing standards,improving the judicial initiative to achieve the goal of justice in each criminal case.更多还原
