【摘要】 我国检察官司法责任追究制度虽然已具雏形,但无论是理论准备,还是制度体制,均未形成一套完整的制度体系。理论层面应明确检察官司法责任追究机制应遵循的基本原则,厘清司法责任的基本类型,明确司法责任的诸项构成要件。完善我国检察官司法责任追究制度,应以现有机制为基础,针对检察官的责任追究作出单独的规定,同时围绕追责机构、事由,责任承担方式,追责程序以及豁免制度分别加以构建。更多还原

【Abstract】 Although prosecutors’ judicial accountability system in China has already taken its initial form, there has been no complete system in terms of theoretical preparation and institutional system. On the theoretical level, the basic principles should be clarified to be followed by the prosecutor’s judicial responsibility investigation mechanism. The basic types of judicial responsibility should be established. The various constituent elements of judicial responsibility should be defined. To improve the judicial accountability system for prosecutors in China, we should take the existing mechanism as the basis, formulate separate provisions for the accountability of prosecutors, and build spate elements of regulations concerning accountability agencies, reasons, methods, procedures and immunity systems.更多还原
