【Abstract】 Legislation,law enforcement,and justice,whether in China or in the West and whether in ancient or modern times,all faces some common problems,and Chinese jurisprudence can provide its solutions rich in Chinese wisdom.The theme of Huang Yuansheng’s The Legal Systems of Han and Tang Dynasties and the Confucian Tradition is precisely "to demonstrate that the tradition comes from the classics,which in return show legal principles." With detailed descriptions,meticulous thinking,and elegant diction,the book shows readers another aspect of Chinese jurisprudence which is different from previous understandings,that is,using law as an objective standard to characterize social behavior and pursue fairness and justice.Behind this is the organic unity of Chinese legal principles,legal intentions and norms.To read this book,one must also understand Huang’s methodology,which is based on a trilogy of the collection,analysis and digestion of historical data.From the three dimensions of time,space and facts,the book presents three major focuses respectively on tracing the changes from the past to the present,distinguishing the differences between China and the West,and studying the principles of the present.In the reciprocal cycle formed by the three elements of historical data,historical facts,and historical view,the book shows the distinctive feature of using history to prove law,interpreting history with law,letting history and law illuminate each other,and pursuing an interdisciplinary integration.Through the refraction of historical legal thoughts,legal norms and their interrelationships,the book offers an insight into human nature in both Chinese and Western histories,so as to reveal the wisdom of the ancient and modern connections of Chinese legal principles.This is the fundamental interest of Huang’s methodology.As the fruit of over 40 years’ hard work in the teaching and research of the history of Chinese law,The Legal Systems of Han and Tang Dynasties and the Confucian Tradition fully shows Chinese jurisprudential wisdom and its author has set a good model for Chinese academics in legal history who care about the present and the future of legal civilization.更多还原
