【摘要】 小产权房在大城市周围的郊区和农村大量存在,随着国家对小产权房限制措施的实施,小产权房日益成为各地政府面临的一个棘手问题。小产权房的形成是经济转轨过程中村集体、村民、购买人、政府无规则博弈的结果,集体土地所有权权能的缺失和土地利益分配的不公是其产生的根源。要从根本上解决此问题,需要改革我国长期以来形成的城乡二元土地制度,建立集体建设用地使用权流转制度,但这在短时间内难以达到,当前要做的是区分不同情况予以灵活解决。更多还原

【Abstract】 The small property right house abounds in suburban and rural areas around large cities.With the implementation of the nation’s restrictions on the small property right house,the small property right house has increasingly become a thorny problem to all local governments in China.The formation of small property right house is the result of the irregular game between village collective,villager,purchaser and government in the process of economic transition,the absence of collective land ownership’ s powers and functions and the unfair of land interest distribution are its root causes.In order to solve the problem fundamentally,it need to reform our nation’s long-established rural dual land system and establish the circulation system of the right to use collective construction land.What needs to do now is distinguish the different situations and thus solve them flexibly.更多还原
