【摘要】 关于海盗赎金的法律定性中国没有规定,导致实践中保险赔偿争议颇多。从海盗赎金定义入手,明确海盗赎金范围。首先研究一国国内公法对支付海盗赎金的合法性问题的态度,再从国内相关私法角度分析海盗赎金的法律定性,最后针对海盗赎金保险赔偿的可能性加以探讨。通过比较现行国内外立法及主要保险条款,分析中国海盗赎金保险赔偿的法律障碍。更多还原

【Abstract】 There are no regulation on insurance compensation for pirate ransom in China and in practice there is no uniform approach to solve this problem. The paper defines the pirate ransom and clarifies the scope of pirate ransom. By analyzing whether the payment of pirate ransom is legitimate under domestic public law and clarifying the legal character of pirate ransom under the relevant private law,the paper discusses the possibility of insurance compensation for pirate ransom. It also analyzes the legal barriers to insurance compensation for pirate ransom through comparative analyses between the current legal framework in China,the relevant legislation abroad and major standard clauses for priate ransom.更多还原
