【摘要】 鼓励和支持大学生创新创业,需要完善的法律体系保障。现有的大学生创业法律中存在立法理念滞后、渊源层次不高和内容尚存空白等问题。大学生创业法律制度应当树立以政府为主导社会共同参与、协同创新和共享发展的立法理念。我国目前宜采取混合立法模式,设立统一的大学生创业基本法并辅之以单行专项立法。因此,应以《大学生创新创业法》为龙头,完善大学生创新创业教育和培训法规,修改和出台大学生创业激励扶持的法律制度,对大学生创新创业行为给予全过程全方位的保护和支持。更多还原

【Abstract】 To encourage and support university students’ innovation and entrepreneurship requires a sound legal system. There are some problems in the existing law of University students’ entrepreneurship, such as backward legislative ideas, low level of origin and blank content. The legal system of University Students’ entrepreneurship should establish a legislative concept of government-led participation, collaborative innovation and society shared development. At present, China should adopt a mixed legislative model and set up a unified basic law for university students’ entrepreneurship, supplemented by a single special legislation. Therefore, the model should take the "University Students’ Innovation and Entrepreneurship Law" as the lead, improve the innovation and entrepreneurship education and training regulations for university students, revise and introduce the legal system for university students’ entrepreneurial incentives and support, and provide all-round protection and support to university students’ innovation and entrepreneurship.更多还原
