【摘要】 宪法上人格尊严的内涵是一个长期令人困扰的难题,尤其表征在理论与实务中宪法上人格尊严与民法上人格尊严存在混淆与错位的图景。当务之急是对二者间的相异与交互做系统的梳理与阐释,以厘清各自的适用范围与边界。就二者间的相对独立性来说,主要体现在功能性差异、法律的形成余地以及宪法不能成为私法裁判的直接依据上。而基本权利的客观法属性以及人格尊严话语体系的特殊性又使二者的交互成为可能。民法上人格尊严的认定要素对宪法上人格尊严的界定具有积极含义,并为人格尊严内涵的理解搭建起了基础框架,宪法上人格尊严的本质应认定为一般人格权。借由宪法规范与民法规范动态的循环解释使宪法的价值贯穿于部门法之中,由此实现宪法上人格尊严与民法上人格尊严的良性互动。更多还原

【Abstract】 The connotation of personal dignity in the constitution has been a perplexing problem for a long time, and especially embodied in the situation of confusion and dislocation between constitution law and civil law in theory and practice involving in personal dignity. It is imperative to systematically sort out and explain the dissimilarity and interaction between them, and clarify their scope and boundaries. In terms of relative independence, mainly reflected in the functional differences, the formation of the law and the constitution can not be the basis for judicial decisions. However, because of the objective law character of fundamental rights and the particularity of the discourse system of human dignity, the interaction between them is possible. The constitutive elements of personal dignity in civil law have positive implications for the definition in constitution, and establishing a basic framework for the understanding of the connotation of personal dignity. Personal dignity in constitution should be recognized as general personality right. Through the dynamic circular interpretation of constitutional norms and civil law norms will make the value of the constitution permeate departmental law, thus, the benign interaction of personal dignity between the constitution and civil law can be realized.更多还原
