【Abstract】 There are a large number of medical damage liability cases,but there are disputes over the application of laws.At the time of implementation of the new interpretation of the Supreme Court,the article sorted out whether the other benefits of victims of medical injury could offset the medical damages,the calculation of the compensation for medical damage caused by multiple factors,the punitive damages for the deliberate sale of unqualified medical products,and the determination of compensation standards for medical damage caused by different geographical medical institutions,the legal theory,legislation and controversy in the five major areas such as medical damages and compensation for mental damages,put forward the view of applicable law.更多还原
