【摘要】 《塔林手册2.0版》确立了一套在网络空间行使国际管辖权的规则指引,包括一般原则、属地管辖权、域外管辖权、域外执行管辖与国际合作、管辖豁免等几个方面的内容。《塔林手册2.0版》不仅对传统国际管辖权规则在网络领域的适用进行了重述,还在网络活动国际管辖权规则上有一定创新,当然也遗留了一些尚未解决的问题。《塔林手册2.0版》所包含的网络活动国际法规则是对现代国际法规则在网络活动中的运用实践的确认,虽然存在一定的模糊性和不足,但这可以通过实务界和学术界协力加以解决。更多还原

【Abstract】 Tallinn Manual 2.0 on the International Law Applicable to Cyber Operations sets forth the guideline rules regarding international jurisdiction over cyber activities in cyberspace. These guidelines include the principles by which a State can claim international jurisdiction, territorial jurisdiction, jurisdiction over activities abroad, executive jurisdiction and international cooperation,immunity from jurisdiction. Tallinn Manual 2.0 not only restates the current practice of the application of traditional international jurisdiction rules in cyberspace, but also introduces some innovations to the traditional rules and certainly leaves some issues unresolved. The rules included in Tallinn Manual 2.0 are the confirmation of current practice of applying international jurisdiction rules to internet. They inevitably bring forth some uncertainties and vagueness in the regulation, which can only be cured by further state practices in this field.更多还原
