【摘要】 2015年通过的《巴黎协定》第七条及其相关规定设立了"适应"制度的大致框架,规定了全球适应目标、国际社会在"适应"领域的合作与支持,以及国家驱动为主的"适应"模式,极大地推动了"适应"在国际环境立法中的发展。然而《巴黎协定》中"适应"制度存在着全球适应目标模糊、资金分配失衡、追踪机制框架化等问题,影响着"适应"制度的实施效果。对此,有必要以国家自主贡献为依托,通过平衡"减缓"与"适应"资金分配等方式完善"适应"制度。此外,中国应当重视与《巴黎协定》"适应"制度的衔接,积极开展"适应"行动。更多还原

【Abstract】 Article 7 of the Paris Agreement adopted in 2015 and its related regulations established a general framework for the"adaptation"system,stipulating global adaptation goals,cooperation as well as support of the international community in the "adaptation"field and the "adaptation"model mainly driven by nations greatly promoted the development of "adaptation"in international environmental legislation.However,the"adaptation"system in the Paris Agreement has such problems as ambiguity of global adaptation,imbalance of capital allocation and framework of tracking mechanism,which affects the implementation effect of the"adaptation"system. In view of this,it is necessary to base on the nations’ voluntary contribution to perfect " adaptation"system through balancing the capital allocation between retarding and "adaptation". In addition,China should attach importance to linking up with the "adaptation"system of the Paris Agreement and actively carry out the "adaptation" action.更多还原
