【摘要】 精准脱贫与环境保护之间具有相互依存、相互影响的利益关联性。二者之间利益的失衡既使个人利益与社会整体利益存在冲突,也使精准脱贫行为与环境保护管制行为之间存在冲突,更使法律利益耦合与法律行为规范之间存在冲突。精准脱贫与环境保护之间的多维法律利益的冲突与失衡进一步加剧了精准脱贫地区的生态恶化和生态"贫困"。矫正二者之间的失衡利益关系,需要尊重环境正义原则,建构与完善程序化与非程序化的法律实施机制和环境公益诉讼制度,共同推动精准脱贫与环境保护的协同共进。更多还原

【Abstract】 Precision poverty alleviation and environmental protection involve both personal interests and social interests as a whole,and multi-dimensional interests such as economy,politics and spirit.There are interests and conflicts of behavior norms between the two. From the perspective of environmental law,this paper analyzes the multi-dimensional legal interest relationship between precision poverty alleviation and environmental protection,and explores the procedural legal enforcement mechanism,the non-procedural legal enforcement mechanism and the environmental public interest litigation system with the benefit balancing method of law and the benefit adjustment function of environmental law,so as to promote the coordinated progress between precision poverty alleviation and environmental protection.更多还原
