【摘要】 污染者负担原则是环境领域的基础性准则,是土壤污染治理领域的根本原则。但是,在土地买卖的情形下,由于转让方的难以确定性,为迅速防治土壤污染,由受让方承担土壤污染的治理责任并赋予其事后向污染主体追偿的权利具有合理性。基于行政法上的比例原则,政府应最小程度地承担土壤污染的兜底责任,以维护纳税人的利益,但基于政府的环保职责,在没有主体修复土壤污染时,政府应有所作为。更多还原

【Abstract】 The polluter pays principle is the basic principle in the field of environment,the fundamental principle in the field of soil pollution control. It is reasonable for the transferee to take the responsibility of soil pollution control and give the transferee right to recover from the polluter afterwards in the case of land sales. Based on the principle of proportion in administrative law,the government should bear the responsibility of soil pollution to the minimum extent to protect the interests of taxpayers,but based on the environmental responsibility of the government,the government should do something when there is no main body to repair soil pollution.更多还原
