【摘要】 传统犯罪在网络空间的兴起和发展是信息化时代的一种犯罪常态。借助发达的信息网络技术,当前我国网络赌博犯罪呈现出严峻态势,其中又以网络开设赌场犯罪较为常见。建立"赌博网站"或"赌博微信群"是典型的网络开设赌场行为,赌博游戏软件在运营中因违规操作而为他人赌博提供平台的,属于非典型的网络开设赌场行为。非典型网络开设赌场行为的刑法适用,要贯彻企业家保护政策、宽严相济刑事政策以及赌博违法犯罪治理政策。在非典型网络开设赌场行为的刑法定性中,开设、赌博、赌场、抽头渔利是核心要素。关于非典型网络开设赌场犯罪的量刑,要侧重从社会管理秩序、赌博游戏软件的属性以及行为人开发该软件的目的等方面对案件的不法程度和责任程度进行实质评价,不宜采用传统开设赌场罪的量刑思维和"赌博网站型"开设赌场罪的量刑标准。更多还原

【Abstract】 The rise and development of traditional crimes in cyberspace is a normal crime in the information age.With the help of a well-developed information network technology, online gambling crimes in China presenta serious situation currently, and crimes of opening online casino are more common. It is a typical behavior of openingonline casino to establish "gambling sites" or "gambling WeChat group". Behaviors of providing platform for others’ gambling due to illegal operation of gambling game software in the operation belong to atypical behavior of openingonline casino. The criminal law application to atypical behaviors of opening online casinos requires the implementation of the policy of entrepreneur protection, the policy of combining leniency with severity, and the policy of controlling illegal gambling crimes. In defining atypical behaviors of opening online casino under the criminal law, the establishment, gambling, casino and fishing for profit are the core elements. In crime sentencing of atypical behaviors of opening online casino, the degree of wrongfulness and responsibility of cases shall be evaluated in a substantial way from the attribute of social management order, gambling game software and actors’ purposes of developing software. Traditional crime sentencing thinking of opening casino and sentencing standards of crime of opening casino by "gambling sites" should not be used.更多还原
