无人驾驶碰撞算法的伦理立场与法律治理

【摘要】 无人驾驶作为人工智能应用的典型,其碰撞算法的价值选判是法律与伦理共同关注的核心命题。碰撞算法伦理的发展可以被归结为前机器伦理赋予阶段和机器伦理自主实施两个阶段,但机器伦理自主实施阶段有其独特性和自主性。法律治理同样应注意这两个阶段的区分。从信息社会背景和发展人工智能技术出发,碰撞算法伦理应当优先选择规则功利主义,坚持人本主义命题,并通过自下而上的算法学习来实现。法律政策在兼顾算法伦理的基础上,应当支持和引导企业研究和发展碰撞算法伦理。立法应积极介入碰撞算法伦理的建构和塑造,防止自生伦理取代法律公正。就具体策略而言,部门法对碰撞算法应当力争平衡伦理自决与法律强制。此外,发展法律技术是确保碰撞算法法律治理的必要条件。

【Abstract】 Unmanned vehicles is a typical application of artificial intelligence, and the value selection of collision algorithm in unmanned vehicles is the core topic of the common concern of law and ethics. The ethics of collision algorithm can be attributed to pre machine ethics and autonomous implementation of machine ethics, but the machine ethic has its uniqueness and autonomy. Legal governance should also adhere to this distinction. In the view of information society and AI technology, collision algorithm should select Rule Utilitarianism firstly, stick to humanism, and realize them through the algorithm learning from the bottom to the top. On the basis of algorithm ethics, legal policy should support and guide the development of enterprise’s algorithm ethics. Legislation should be timely involved in the construction and modeling of collision algorithm, so as to prevent the replacement of legal justice by self ethics. As far as specific legal strategies are concerned, the departments of law should strive to balance ethical self-determination and legal coercion. In addition, the development of legal technology is a necessary condition to ensure the legal governance of collision algorithm.
