【摘要】 检察公益诉讼入法已时间不短,关于检察机关在公益诉讼中的地位,已由争论转为悬置。诉讼地位可归属于公益诉讼构造的讨论范畴,基于诉讼原理,影响诉讼构造的决定性因素是诉讼目的,同时,诉讼目的的实现也需要相应的诉讼构造加以保障。检察机关基于所承担的宪法职责成为公益诉讼的适格主体,检察公益诉讼的根本性目的是保护公益,其诉讼地位是民事、行政公诉人不是普通原告,在诉讼构造上表现为横向的公诉化构造和纵向的两阶化构造。公诉化的公益诉讼审判模式,不意味着打破原有的审判结构,检察权不能僭越审判权,也不能凌驾于被告方,相反,要承担更多的举证证明义务。检察公益诉讼中,检察机关与审判机关共同担负公益诉讼职权主义的角色功能。两阶化的纵向构造则可充分体现检察机关作为公益诉讼主体的特质性,也有助于保障检察监督功能的发挥。更多还原

【Abstract】 The public interest litigation filed by the procuratorate has been authorized by law for a short time. The greatcontroversies on what role should the procuratorate play have still been in suspense. The litigation status of the procuratorate reflects the construction of the public interest litigation. The ends of the litigation influence decisively the construction of public interest litigation while the fulfillment of the ends should be guaranteed by the construction. The procuratorate is allowed to file a public interest litigation based on its constitutional duties which is protecting the public interest. Therefore, the procuratorate is a public procurator rather than an ordinary plaintiff. It can be illustrated on two aspects: public prosecution horizontally and two-level construction vertically. On the horizontal aspect, the public prosecution does not break the traditional civil trial model and the prosecutorate neither surpass the court nor the defendant. On the vertical aspect, the prosecutorate should undertake more burdens of proof, share the fact finding authority with the court. Meanwhile, the two-level construction reflects the specialty of the procuratorate as the public interest litigator, as well as guarantees the implementation of the procuratorate’s supervision function.更多还原
