【摘要】 摒弃已有从征地拆迁原因和结果切入的理解路径,从征地拆迁过程的角度,认为征地拆迁是地方政府将构筑在农村土地上的国家、集体和个体三重社会性建构进行层层解构,以实现农村土地商品化的过程。社会性解构的主要内容包括国家层面的政策性解构、集体层面的组织性解构和个体层面的关系性解构。社会性解构已成为地方政府实现农村土地商品化的重要方式和手段。与此同时,社会性解构的方式使国家、集体和个体均从属于农村土地商品化。应尽快将社会性解构方式纳入法治化的框架,使征地拆迁在法治规范中进行。更多还原

【Abstract】 This paper abandons the existing research method from the understanding path of the reasons and results of land expropriation and house removal,and from the perspective of the process of land expropriation and house removal,holds that land expropriation and house removal are a process in which the local government will deconstruct the triple social construction of state,collective and individual,which will be constructed on rural land,layer by layer,in order to realize the commercialization of rural land. The main contents of social deconstruction include policy deconstruction at the national level,organizational deconstruction at the collective level and relationship deconstruction at the individual level.Social deconstruction has become an important way and means for local governments to realize the commercialization of rural land. At the same time,the way of social deconstruction makes the country,collective and individual subordinate to the commercialization of rural land. The social deconstruction mode should be incorporated into the framework of the rule of law as soon as possible,so that land acquisition and demolition can be carried out under the rule of law.更多还原
