【摘要】 添附是所有权取得方法的一种,也是确权的重要手段,在民法体系中具有不可或缺的地位。在我国《民法典·物权编》中确立添附制度符合时代要求。最新公布的《民法典·物权编(草案)》中添附制度的现有文本存在理论缺陷。作为强行性规范,添附制度的适用不能因当事人事先约定排除,只有在判断求偿金的时候才考虑主观心态。同时,文本中的援引条款指向不明,将导致实践适用困难。应当对添附制度重新构建,设置其构成要件及法律后果等条款。更多还原

【Abstract】 Accretion is a method of obtaining ownership, and also an important means of confirming property right. Therefore, it has an indispensable position in the civil law system. In the Property Law of Civil Code of China, the establishment of accretion system is in line with the requirements of the times. However, the existing text of the newly edited accretion system of the Property Law of Civil Code has theoretical flaws. As a forcible norm, the application of the accretion system cannot be ruled out by the parties in advance, and the subjective mentality is considered only when judging the claim. At the same time, the invocation of the terms in the text is unclear and will lead to difficulties in applying the practice. The accretion system should be rebuilt, and its constituent elements and legal consequences should be set.更多还原
