【摘要】 以2002～2016中国省级面板数据为基础,运用双向面板模型对法制与保费收入的关系进行了分析,实证结果表明,法治与保费收入水平呈负向关系,即社会法制进步在当前阶段抑制了保险业的发展,多次的稳健性检验可以证明实证结果的可信度。究其原因在于,受费率非市场化、社会对保险的认知不充分、国有企业治理机制不完善的影响,大部分地区保险业的竞争主要集中在不规范的展业与销售,而非产品与服务。在此约束条件下,越是加强法治越会削弱保险业不规范的发展行为,从而在一定程度上会降低保费收入。因此,在加强法治的情境下,保险业应当紧随国有企业改革,着力于加快费率市场化进程和加强民众与企业的风险与保险意识培育,从而为法治规制提供更加具有适应性的配套条件。更多还原

【Abstract】 Based on provincial panel data of China from 2002 to 2016,a two-way panel model is used to analyze the relationship between the legal system and insurance premium income.Empirical results show that the rule of law and the level of insurance premium income are negatively related,indicating that,currently,progress in the societal legal system suppresses development in the insurance industry.Multiple robustness tests confirm the reliability of these results.The main reasons for this are non-marketized premium rates,insufficient understanding of insurance in society,and inadequate governance mechanisms of state-owned enterprises,which cause the competition in the insurance industry in most regions to be concentrated mainly in non-regulated practices and sales,instead of products and services.Under these constraints,strengthening the rule of law will hinder the development of non-regulated behavior in the insurance industry,thereby reducing insurance premium income to a certain extent.Therefore,while the rule of law is strengthened,the insurance industry should follow the footsteps of reform in state-owned enterprises,focus on accelerating the marketization of premium rates,and reinforce the promotion of risk and insurance awareness among the people and enterprises,to ensure more adaptive conditions for a sound legal system.更多还原
