【摘要】 采用文献资料、历史及归纳等研究方法,在梳理英格兰足球组织机构及其职能的基础上,深入剖析了其转会制度变迁的过程与原因,并得出几点启示。研究认为,英格兰职业足球形成了相互制衡、协同发展的稳定三角组织架构,它们在转会制度改革中发挥了不可替代的特殊作用。英格兰职业足球转会制度变迁过程实质是俱乐部与球员相互斗争、彼此妥协的博弈过程,历经了矛盾隐形期、矛盾凸显期、矛盾激化期、矛盾加剧期及矛盾平稳期5个阶段。以此为基础,得出对我国的启示:建立完善足球实体组织机构,形成稳定的相互制衡之势;转会制度设计源头注重权力平衡,保证核心群体的利益充分表达;健全行业集体谈判制度,促进劳资矛盾有效化解;加强转会制度的法治化建设,提高与本土法律的兼容性。更多还原

【Abstract】 Using the methods of documentation,history and induction,this paper makes thorough analysis of the process and causes of its transfer system change based on combing the organizational structure and functions of England football, and draws some enlightenments. The result shows that professional football in England has formed a stable triangular organization structure with mutual checks and balances and coordinated development,which plays an irreplaceable special role in the transfer system reform. The change of England professional football transfer system is essentially game process in which clubs and players struggle and compromise each other. It has gone through five stages:invisible contradiction, prominent contradiction, intensified contradiction, sharpen contradiction and stable contradiction. On this basis,we can draw some enlightenments:establishing and improving the football entity organization,which forms a stable balance of power. The design of transfer system should focus on the balance of power to ensure the full expression of the interests of core groups. We should improve the system of collective bargaining,and promote the effective resolution of labor contradictions. Finally,we should strengthen the transfer system of rule to improve the compatibility with local laws.更多还原
