【摘要】 巡游出租汽车服务准入规制具有审查承运人身份信息、阻却潜在犯罪、保障乘客安全的特殊功能。网络预约出租汽车服务本可以依托网络技术,首次全面收集司机和乘客双方的真实主体信息,从而更有助于保障司机和乘客双方的安全。但网络预约出租汽车服务新规却无视这一根本差别,陷入特许经营的巢臼,以控制运力为本质,必然诱导"黑车"重返市场,既无法缓解交通拥堵,也严重背离安全保障的核心价值。网络预约出租汽车服务的法律规制应当抛弃准入规制模式,通过设立标准和法律责任,明确平台的信息审查和保密义务、交通安全保障义务,辅之以反垄断机制,维护司机和乘客的人身财产安全。更多还原

【Abstract】 The admission regulation of cruise taxi service has the special functions of examining the carriers’ identity information,deterring potential crimes and ensuring passengers’ safety. The online car-hailing service could have relied on the network technology to comprehensively collect the real subject information of both the taxi driver and the passenger for the first time,so as to better protect the safety of both of them. However,the new regulation of online car-hailing service ignores this fundamental difference and falls into the trap of franchising. Taking the control of transportation capacity as the essence will inevitably induce illegal taxis to return to the market,which is not only unable to alleviate traffic congestion but also seriously deviates from the core value of safety guarantee. The legal regulation of the online car-hailing service should abandon the access regulation mode,and clarify the information examination and confidentiality obligation and traffic safety protection obligation of the platform through the establishment of standards and legal responsibilities,supplemented by the anti-monopoly mechanism to maintain the personal and property safety of drivers and passengers.更多还原
