【摘要】 现阶段海南应设置专门的政府机构主导建设自由贸易港知识产权维权援助机制,待社会组织整体发展趋于完善,再尝试将维权援助的主导力量逐步转移到社会组织。海南应当把握好自由贸易港深化改革和扩大开放的整体建设方向,突出市场化和信息化的知识产权维权援助机制构建思路。自贸港应积极运用市场化手段调动维权资源,搭建信息化的市场资源流动平台促进市场援助资源配置,发挥公共资源的补充与扶持作用,同时对维权援助机构的保障性职责作出规定以保障援助效果。在自贸港知识产权维权援助的具体规则设计方面,海南应借鉴各地实践中的有益经验,对机构设置、援助内容、援助方式、援助对象范围作出合理安排。更多还原

【Abstract】 At present,Hainan is suggested to set up a special government agency to construct the rights-safeguarding assistance mechanism for the intellectual property of free trade port,and then try to transfer the leading force of rights-safeguarding assistance to the social organizations gradually when their overall development tends to be perfect. Hence,Hainan should grasp the overall construction direction of deepening the reform and expanding the opening up in the free trade port,highlighting the ideas of marketization and informatization to construct the rights-safeguarding assistance mechanism for the intellectual property. In terms of the free trade port,the market-based means should be adopted to mobilize the rights-safeguarding resources,an information-based platform for the flow of market resources must be built to promote the allocation of market-assisting resources,the public resources are to be fully utilized to realize their supplementary and supportive function,and in the meantime the protective duties of rights-safeguarding assistance agencies should be stipulated to ensure the effects of assistance. When it comes to the design of specific rules and regulations for the rights-safeguarding assistance with the intellectual property of free trade port,Hainan is also suggested to acquire some advantageous experience from the practices in the different areas,making feasible arrangements for the setup of institutions,the content of assistance,the methods of assistance,and the scope of assisted subjects.更多还原
