【摘要】 本文从背景技术的选取、实验数据的提供、说明书层次的设置等几方面对专利申请说明书的撰写方法进行了讨论。通过对具体案例进行分析,阐述了在说明书的撰写过程中,正确选取背景技术在授权、确权程序中都对创新主体有益,故意选择更低级别的背景技术从而人为夸大技术效果的做法不可取;而提供恰当的实验数据,有助于证实发明的技术效果和发明高度;此外,为说明书记载的技术方案设置一定层次,则能留好退路,进一步保证科技创新的权利化。本文同时根据技术人员和专利代理人的角色特点,有针对性的提出了相应的建议和意见。更多还原

【Abstract】 The importance of appropriate background, enough experiment data and arrangement of patent are discussed. Firstly, the appropriate background is helpful during grant and af?rmation proceeding.Picking the lower background to aggrandize the technical effect is not advisable; secondly, providing enough experiment data is useful for proving the creativity of patent; thirdly, inventor can settle for something that was second best from arrangement of description, and it will be helpful for patent grant.Besides, we give some suggestions to inventors and patent agents base on their roles.更多还原
