【摘要】 为实现破产重整的目标,对债务人财产价值进行保全至关重要,其中最重要的机制是"自动停止"制度的运用。自动停止制度不仅可有效阻止债权人的个别讨债行动,而且有助于债务人的继续经营,使债务人的复兴成为可能,并能为鼓励债务人发起破产重整程序提供重要的动力。但对破产重整的债务人财产施以保全的任何措施,都是对债权人行使其破产程序前已有权利的限制和削弱,本质上是对债务人和债权人之间的法律关系做出另外的安排。因此必须在保全债务人财产的同时,注意保护权利人的已有权利不受到实质性的损害。更多还原

【Abstract】 In order to achieve the goal of reorganization, it is essential to preserve the value of the debtor’s property. The most important mechanism is the "automatic stay". The automatic stay not only effectively prevents creditors from individual debt collection actions, but also helps the debtors continued operations, making the debtors a renaissance possible, and providing an important impetus to encourage debtors to initiate reorganization procedure. However,any measure of the preservation is a restriction and weakening of the creditor’s rights already existing before insolvency proceeding. Essentially, it is a different arrangement for the legal relationship between the debtor and the creditor.Therefore, it is necessary to protect the creditor’s existing rights from substantial damage while preserving the debtor’s property.更多还原
