【摘要】 中国国际物流的体量对国际物流仲裁的需求已经今非昔比。在美国和西方贸易保护主义抬头的大背景下,加强中国国际物流仲裁建设具有现实的紧迫性和重大的战略意义。然而,与成熟的市场经济国家相比,中国国际物流仲裁存在一些亟待完善的问题,可以大体归纳为三个"供给不足"、一个"认识不到位"和一个"不健全"。为此建议:加强中国国际物流仲裁人力资源的供给;加强中国国际物流仲裁法律法规的供给;深化中外国际物流仲裁的合作以及国际物流仲裁与司法的合作;加强对国际物流仲裁在内的商事仲裁的宣传供给;以开放心态借鉴各国仲裁制度中先进的和有益的成分,进一步完善中国的国际物流仲裁制度,并积极参与国际物流仲裁规则的制定。更多还原

【Abstract】 The demand of the volume of international logistics arbitration for the volume of China ’s international logistics has changed. Against the backdrop of the rise of trade protectionism in the United States and the West,it is of great urgency and strategic significance to strengthen the construction of international logistics arbitration in China. However,compared with mature market economy countries,there are some problems that need to be perfected in China ’s international logistics arbitration,which can be roughly summarized as three "insufficient supply",one "not aware of the position"and one "not sound". To this end,the following suggestions are proposed: strengthen the supply of human resources for international logistics arbitration in China; strengthen the supply of international logistics arbitration laws and regulations,actively participate in the formulation of international logistics arbitration rules; deepen the cooperation of international logistics arbitration and international logistics arbitration and judicial cooperation; strengthen the publicity and supply of commercial arbitration including international logistics arbitration; with an open mind and learning from the advanced and beneficial things in the arbitration systems of various countries,we will further improve China’s international logistics arbitration system and actively participate in the formulation of international logistics arbitration rules.更多还原
