【摘要】 竞争中立规则的提出旨在为国有企业和私营企业创造一个公平的竞争环境,减少市场经济的低效率。澳大利亚竞争中立的法律化实践,CPTPP协议的竞争中立规则和OECD制定的竞争中立规则都表明:竞争中立规则已经具有明显地法律化趋势。竞争中立规则的直接规范对象就是国有企业,使私营企业和国有企业的竞争处于一个公平的环境当中。中国引入竞争中立规则后的应对,应当倒逼国内改革,向国际规则靠拢;引入竞争影响评估机制;完善我国《反垄断法》规制行政性垄断的规定;建立完善的法律体系,加强市场监管;以"一带一路"倡议,加快构建多边贸易合作体系。要对竞争中立规则细节和发展走向进行技术层面和战略层面的研究,了解清楚利与弊、危与机,提前做好调整和布局。更多还原

【Abstract】 The competition neutrality rule is proposed to create a level playing field for state-owned enterprises and private enterprises,and to reduce the inefficiency of the market economy. Australia’s competitive neutralization practices,the competition neutrality rules of the CPTPP agreement and the competition neutral rules established by the OECD all indicate that the competition neutrality rules have a clear legalization trend. The direct normative object of the competition neutrality rule is the state-owned enterprise,which makes the competition between the private enterprise and the state-owned enterprise in a fair environment. After China introduces the rules of competition neutrality,it should force domestic reforms to move closer to international rules; introduce a competitive impact assessment mechanism; improve China’s Anti-Monopoly Law to regulate administrative monopoly; establish a sound legal system and strengthen market supervision; Accelerate the establishment of a multilateral trade cooperation system with the "One Belt,One Road"initiative. It is necessary to conduct research on the technical and strategic aspects of the details and development direction of the competition neutrality rules,understand the pros and cons,and endanger the opportunities,and make adjustments and layouts in advance.更多还原
