【摘要】 目的阐明剂型改良对中药专利再保护的重要意义,并探索其实践途径。方法基于中药相关发明专利无效宣告数据的结果分析,分析剂型改良对中药专利再保护的重要意义;从专利审查标准和中药自身特点来寻找剂型改良对传统中药再保护具体实践途径及策略。结果中药剂型改良实施专利申请是传统中药专利再保护的有效途径。结论剂型改良是对传统中药进行二次开发的实施途径之一,也是对传统中药专利再保护的有效途径。针对传统剂型的缺陷摸索出该中药适宜的新剂型,并通过大量的实验设计出最优选的辅料、配比和制备工艺。对传统中药专利再保护能够完善中药专利保护体系,促进中药产业现代化和国际化。更多还原

【Abstract】 Objective To clarify the significance of dosage form improvement for patent re-protection of traditional Chinese medicine,and explore its practical approaches. Methods Based on the result analysis of invalidation big data of patents of traditional Chinese medicine related inventions,the significance of dosage form improvement on the protection of traditional Chinese medicine patent was analyzed. From the examination standards of patent and the characteristics of traditional Chinese medicine to find out the specific practical approaches and strategies for the protection of traditional Chinese medicine by dosage form improvement. Results Patent application for the dosage form improvement of traditional Chinese medicine was an effective way to re-protect traditional Chinese medicine patents. Conclusion Dosage form improvement is one of the ways to carry out the secondary development of traditional Chinese medicine,and it is also an effective way to re-protect the patents of traditional Chinese medicine. Aiming at the defect of traditional dosage forms,a new dosage form suitable for the traditional Chinese medicine is explored,and the optimum excipients,formulation and preparation technology are designed through a large number of experiments. Re-protection of traditional Chinese medicine patents can improve the patent protection system of traditional Chinese medicine and promote the modernization and internationalization of traditional Chinese medicine industry.更多还原
