【Abstract】 Fundamentally speaking,the establishment of the principle of the "public orders and good customs"is the inevitable requirement and results of the two major historical processes. For economic reasons,the economic foundation determines the superstructure,historical development of market economy needs the "public orders and good customs"to be confirmed and preserved by national laws; from the cultural influence,the"public orders and good customs"are the reflection which is Chinese excellent historical and cultural tradition"creative transformation and innovative development"in the superstructure of the law.
