【摘要】 信托是为了他人的利益而持有和管理财产的制度安排。信托的本质、西方的文化传统和规制老人经济虐待的需要催生了英美老人财产信托制度。通过考察英美老人信托制度的先进经验和中国独特的文化传统,提出我国在老人财产信托制度构建方面应该强化政府的监管与教育职责、建立金融机构在信托财产的管理与运用上的信义义务、完善老人财产信托法律体系等。更多还原

【Abstract】 Trust is the institutional arrangement for holding and managing property for the benefit of others. The nature of trust,the Western cultural tradition and the regulation of economic abuses of the elderly led to the property trust system for old people.Through the investigation of the advanced experience of the British and American trust systems for the elderly and the unique cultural tradition of China,it is suggested that the supervision and education responsibility of the government should be strengthened in the construction of a trust system for old people’s property,the trust obligations of the financial institutions in the management and use of the trust property should be established,and the legal system of trust for old people’s property should be improved.更多还原
