【摘要】 采用文献资料法等检视我国现行公共体育服务法律体系的问题,探索完善公共体育服务法律体系的举措。研究发现,我国公共体育服务法律体系存在立法理念"缺位"导致法律体系的定位偏离;立法形式"疏漏"造成法律体系的规范模糊;立法后评估"缺失"制约法律体系的功能省思。建议:确立以民生为旨归的"建构性法律"体系;促进"两型多部门"法律制度的包容性发展;完善立法的"纵横"层次;实施立法后评估工作。更多还原

【Abstract】 Methods of literature review and so on are adopted to view the problems of existing law system of public sports service in China and explore the perfecting measures. The study has found that: the concept of public sports service legislation is "absent"; the legislative form is "oversight"; lack of functional reflection after legislation evaluation work. Suggestion: to establish the "constructive law" system that aims at people’s livelihood; to promote the inclusive development of the "two-type and multi-sectoral" legal system; to improve the "horizontal aspect" of legislation; to implement postlegislation evaluation and assurance.更多还原
